The Forest Rights Act

Bombay High Court

Sevanivrutta Vana Karmachari Sangh vs. Union of India and Ors. (PIL 21 / 2008) Petitioners: Sevanivrutta Vana Karmachari Sangh (Retired Forest Officers Association)
Respondents: Union of India (MoEF, MoTA), Government of Maharashtra, PCCF Maharashtra

A detailed petition making the basic arguments, in addition to the following:
  • The inclusion of non-tribals in the Act is a threat to tribals.
  • The Act was passed in "haste" and without an adequate database of its likely impact.
  • The definitions of forest dwelling Scheduled Tribe and Other Traditional Forest Dweller are too vague.
  • The recognition of land rights discriminates against those who have not occupied forest land.
  • The petition also contains text that appears to have been cut and pasted from the Madras, Madurai, Andhra Pradesh, Karnataka and Orissa petitions.

Status: The matter has been heard a few times, and the petitioners have been asked to amend their writ petition.  The matter was last heard in the first week of August and adjourned simpliciter for four weeks.
